Legal framework - compliance with GDPR and French law

 

Sicara declares that the company processes personal data in compliance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the GDPR) and French law n° 78-17 of 6 January 1978 relating to data processing, files and freedoms.

Recipients of personal data

The recipients of the data are the marketing and customer relationship management services of SAS Sicara. We only share your personal data with the following third parties:

  • Hosting provider for our website Marketing service providers to develop and manage our website, contact forms or carry out our advertising campaigns (such as sending emails).
  • We only share your personal data with other third parties if we are legally obligated to do so or if required by public authorities (e.g., judicial authorities).

We do not share your data with our partners without your consent.

 

Duration of retention for personal data

 

In accordance with Regulation 2016/679 of April 27, 2016, Article 5(e), personal data collected by Sicara is stored in a form that allows the identification of the persons concerned for a period not exceeding that necessary in relation to the purposes for which they are processed.

Data necessary for compliance with a legal obligation is stored in accordance with applicable provisions (including, but not limited to, those provided for by the Commercial Code, Civil Code, and Consumer Code).

 

Do we realize data transfer outside the European Union?

 

We carry out our processing within the European Union and do not transfer our data to recipients located outside the European Union.

However, some technical service providers who are recipients of your personal data may be located outside the European Economic Area, such as the United States (Google services).

As a result, your personal data may be processed in countries that are not recognized as offering an adequate level of protection for personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

 

Sicara requires the same level of protection for your data as required by all applicable laws and regulations on European territory and ensures that its service providers are either bound by European Commission's standard contractual clauses or engaged in BCR (Binding Corporate Rules) within their international group and have been duly authorized by a data protection supervisory authority established in the EU territory, or have adhered to any program allowing for the recognition of equivalent protection within their country.

 

Rights of the person whose data is collected

 

The person whose personal data is collected has the right to:

  • request access to personal data, as well as rectification or erasure of such data, or restriction of processing concerning the data subject,

  • object to processing,

  • data portability,

  • lodge a complaint with a supervisory authority,

  • withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal, provided that the processing is based on Article 6(1)(a) or Article 9(2)(a) of the GDPR, i.e. on the data subject's consent to the processing of his or her personal data for one or more specific purposes.
